Apple is accused of selling copies of the operating system to manufacturers of generic Intel-based hardware. The company defended itself in court proceedings claiming he had legitimately bought the same operating systems, without any limitation in regard to initial any resale. Apple says Psystar is reselling rather than computer software protected by copyright according to the logic of distribution that would result in a violation of rights.

the situation is particularly complex: Apple says that the operation performed by the company would be in conflict with the provision 117 of the Copyright Act, calling into question the eula, signed by the parties, which would prohibit users from installing the operating system on hardware not sold directly from Apple.

Psystar's argument in this regard is quite clear: it would be absurd to buy operating systems, however, entitled to purchase apple, then without the ability to mount them on other machines. Psystar's CEO states "... it is easy for Apple to sell its software first and then claim that can not be used outside of its scope."

quoting an article of the same act, Psystar is still note that a fold of the law allows you to sell copies of a product without the original producer to exercise a right of distribution in respect of these couples legally purchased.

apple, when pressed by arguments of this kind, declined to comment, deferring all the decisions of the court.
